DOUBLE PAY FOR WORKERS ON APRIL HOLIDAYS

Baguio City - Workers who reported for duty to their employers or companies on April 9, 18, and 19, respectively, will get paid twice their regular daily wages, DOLE-CAR Regional Director Exequiel Ronie Guzman said.

RD Guzman citing Proclamation No. 555 issued by President Rodrigo Duterte and Labor Advisory No. 05, series of 2019 issued by DOLE Secretary Silvestre H. Bello III for the payment of wages for April 9 – Araw ng Kagitingan, April 18 – Maundy Thursday, and April 19 – Good Friday, as regular holidays,  including April 20 – Black Saturday, which is a special non-working holiday.

“The DOLE prescribes the following pay rules for a regular holiday: If the employee did not work, he/she shall be paid 100 percent of his/her salary for days indicated ([Basic wage + COLA] x 100 percent); while for work done during the regular holiday, the employee shall be paid 200 percent of his/her regular salary for the first eight hours ([Basic wage + COLA] x 200 percent) while for overtime work (work done in excess of 8 hours), he/she shall be paid an additional 30 percent of his/her hourly rate (hourly rate of the basic wage x 200 percent x 130 percent x number of hours worked).” Guzman added.

Related to this, if an employee works on a regular holiday that also falls on his/her rest day, he/she shall be paid an additional 30 percent of his/her basic wage of 200 percent [(Basic wage + COLA) x 200 percent] + [30 percent (Basic wage x 200 percent)] while for overtime work on a regular holiday that also falls on his/her rest day, he/she shall be paid an additional 30 percent of his/her hourly rate on the said day (hourly rate of the basic wage x 200 percent x 130 percent x 130 percent x number of hours worked).

On the other hand, the following pay rules should be observed on April 20 – Special Non-working holiday: If the employee did not work, the “no work, no pay” policy shall apply unless there is another company policy, practice, or collective bargaining agreement (CBA) granting payment on special days.

For work done during the special non-working holiday, he/she shall be paid an additional 30% of his/her daily rate on the first eight hours of work [(basic wage x 130%) + COLA].

For work done in excess of eight hours (overtime work), he/she shall be paid an additional 30% of his/her hourly rate on the said day [hourly rate of the basic wage x 130% x 130% x number of hours worked].

If an employee works on a special holiday that also falls on his/her rest day, he/she shall be paid an additional 50% of his/her daily rate on the first eight hours of work [(basic wage x 150%) + COLA].

For overtime work on a special holiday that also falls on his/her rest day, he/she shall be paid an additional 30% of his/her hourly rate on the said day [Hourly rate of the basic wage x 150% x 130% x number of hours worked]./Patrick Rillorta
