DOLE to employers: Observe pay rules on EDSA Day

Baguio City – The Department of labor and Employment (DOLE) reminded private sector employers to properly pay their workers who reported for work on February 25, the Anniversary of the EDSA People Power Revolution.

DOLE CAR Regional Director Exequiel Ronie A. Guzman said Labor Advisory No. 8 Series of 2020 issued by Acting Secretary Ana Dione prompted employers to observe the proper payment of wages on said date, which is a special non-working holiday.

Guzman said that employees who will work on the said day shall be paid an additional 30 percent of their basic wage in the first eight hours. Their basic wage shall be multiplied by 130 percent plus COLA.

“If the employee did not work, however, the “no work, no pay” principle shall apply unless there is a favorable company policy, practice, or collective bargaining agreement (CBA) granting payment on a special day.” the Director added.

If they work in excess of eight hours, they will be paid an additional 30 percent on their hourly rate. The computation is ‘hourly rate of the basic wage x 130 percent x 130 percent x number of hours worked.’

For work done during a special day that also falls on the workers’ rest day, they shall be paid an additional 50 percent of their basic wage on the first eight hours of work, or [(basic wage x 150 percent) + COLA].

Lastly, for overtime work during a special day that also falls on the workers’ rest day, they shall be paid an additional 30 percent of their hourly rate.

Thus, the computation will be ‘hourly rate of the basic wage x 150 percent x 130 percent x number of hours worked.

Meanwhile, DOLE issued last year Labor Advisory Number 13, series of 2019 pursuant to Proclamation No. 845 issued by President Rodrigo Roa Duterte which listed down the regular and special holidays (nonworking days) to be celebrated this year.

Based on proclamation, the following are declared as regular holidays: New Year’s Day (January 1, Wednesday), Araw ng Kagitingan (April 9, Thursday), Maundy Thursday (April 9), Good Friday (April 10), Labor Day (May 1, Friday), Independence Day (June 12, Friday), National Heroes Day (August 31 or the last Monday of August), Bonifacio Day (November 30, Monday), Christmas Day (December 25, Friday), and Rizal Day (December 30, Wednesday).

For the special non-working days in the first half of the year are the Chinese New Year (January 25, Saturday), the 34th EDSA People Power Revolution anniversary (February 25, Tuesday), Black Saturday (April 11), Ninoy Aquino Day (August 21, Friday), All Saints’ Day (November 1, Sunday), Feast of the Immaculate Concepcion of Mary (December 8, Tuesday), and the last day of the year (Thursday).

the observance of Eid’l Fitr (End of Ramadan), and Eid’l Adha (Feast of Sacrifice), will be issued after the approximate days of the Islamic holidays have been determined in accordance with the Islamic calendar, or upon Islamic astronomical calculations.

Additional special non-working days are All Souls’ Day (November 2, Monday), and Christmas Eve (December 24, Thursday).
